Phat Pharm sues Phag Farm


And we thought the folks at FCUK had balls. Phat Farm, the clothing line founded by Hip-Hop mogul Russell Simmons, has launched a court battle to prevent another company from infringing on the brand’s name.  Lawyers for Phat Fashions, the company that owns the Phat Farm trademark filed a $7 million dollar lawsuit against “Phag Farm,” a Florida-based T-shirt company.
According to the lawsuit, which was filed in US District Court for the Southern District of Miami, Phag Farm is confusing customers by selling T-Shirts that are similar in name to the famous Hip-Hop clothing line.
According to Phat Farm's lawyers, Phag Farm launched in early February of 2011 and started selling "merchandise at virginally identical price points to the apparel items sold by Phat Fashions."
Phat Fashions claims the Phagfarm.com website, which promotes the brand as being "pretty hot and gay" also confuses customers who are seeking PhatFarm.com.
The famous clothing line is also suing for trademark infringement, unfair competition and dilution of the Phat Farm brand.
Russell Simmons founded Phat Farm in 1992. In 2004, Simmons cashed out and sold Phat Farm to Kellwood for $142 million dollars in cash.
